Who is a Mediator?

A mediator is a person who has graduated from a Faculty of Law, has at least five years of expertıse and has successfully passed the Ministry of Justice Mediation Exam.

The mediator is an independent and impartial individual who brings the parties together to discuss and negotiate by applying systematic techniques to help them understand each other. As such, the mediator facilitates the parties in creating their solutions and establishing a communication process between them.

  • The mediator does not judge who is right or wrong and does not perform a judicial function.
  • Unlike an arbitrator or judge, the mediator is not the decision-maker in the process.
  • The parties resolve the dispute through negotiation and agreement based on their own will.
  • The mediator assists in identifying the core issues and interests in the dispute and encourages discussions and solutions on these matters.
  • The parties generate their solutions, trying to understand each other.
  • If it becomes apparent that the parties cannot come up with a solution, the mediator can offer a final proposal for resolution.
